The official game site of the developer is located at <a href='http://www.helbreath.com' target='_blank'>http://www.helbreath.com</a> and legally licensed by <a href='http://www.helbreathusa.com' target='_blank'>http://www.helbreathusa.com</a>. The web site you’re hosting is advertising an illegal Helbreath server. We, iENT, are authorized by the copyright owner, Siementech, to seek out and close illegal servers.
This involves copyright infringement and software piracy related material. The source code for this game was illegally leaked to the public, and altered by those not authorized by the copyright holder. There may be some excuse used that it was 'accidentally leaked' but this is a falsehood promulgated by hackers. At no time has the copyright of the game been abrogated and attempts have always been made to uphold our copyright. Due to another misreading of the Terms of Use we state that the term 'for private use' is to only use the software for playing the game on a licensed server. It does not permit the running of a server without a specific license from Siementech.
This web site also shows detailed information on how to hack the illegally obtained source code.
The participants are violating the copyright agreement as your servers are being used in an illegal fashion. Please take care of this abuse of our copyright and your Terms of Service by removing this website. Please advise me of exactly what action has been taken so that I can advise the copyright owner. Thank you for your prompt action in this matter.

LOL like that is going to stop servers from popping up...as for me i have ALL of there shit and more..most likely most of people who come here are the same..if the site dies a slow death or over night then who really cares most people share what they have so it doesn matter really..

LOL at this they contacted my school a while ago, heres what went on

i received no reply thus far to this email. and have considered that they dont give a shit and just either want to scare me into stopping, or that my case is 100% right that i am not breaking any copyright

All materials and software that you may download from this site, including, but not limited to, any files, images, audio and logos are copyrighted and are owned by either Siementech or iEntertainment Network.

However, we grant you the non-exclusive right to use, for non-commercial and personal use only, to copy any of the materials.

In this case, you are required to include and indicate all copyright and other comments relating to the downloaded contents, accepting and agree that you may not sublicense, assign or transfer this license to anybody.

Hence, you shall not sell, use or distribute associated materials from our website for a commercial purpose.

The copyright holder has the right to cancel this limited use of license at any time for any reason.

I do have a few points in my defence and would like to hear what points still confilct with this copyright violation and what could be changed to be compliant.  These are in reaction to each paragraph

1) I have not claimed ownership of any of the files that could have originated from HBUSA, and the only files hosted that are from there is the mapdata. The Client is from <a href='http://helbreathss.tk/' target='_blank'>http://helbreathss.tk/</a> and if that conflicts with your copyrights I can instead use another client I have been working on from source so that it is not your work.  - I did fail to cite the properownership of the mapdata and possibly client if that is a resolution for use

2) again the only files that are there that I know came straght from HBUSA are unmodifyed and simply copyed, the files that I have are indeed for personal use and I am interested in game devlopment and programming so I have been working on the server in my free time. It is a free-non-comercial server and the only reason it is open to the public is so that i can get  feedback on how players like game features, and gain suggestions for me to work on my programming ability.

3)I failed to cite properly the sources of the files that are indeed owned by HBUSA and would like to hear how you would like the files sourced with.  A COPYRIGHT.TXT file stating ownership of all of your files to HBUSA and IENT?

4)I am not selling anything, no use/distributing for any comercial purpose

with those out of the way that simply leaves me wondering how you would like to have the copyright of the files created and distributed by HBUSA cited, and in the future could you please contact us first about issues instead of going after a file host. There was a contact page afterall, I'd like to see that it was read slightly.

This is because Tamara is in charge now. John didn't so shit, so Tamara had a few months for reorganizing etc, and now she's busting private servers apparently..
