only reason i see to redesign a new client is so we can add new stuff and idea's in, more sprites and more commands.

Depends on the situation. If you rely your answer purely because what happened with GotWow and Blizzard (you was a 0x09 dev I saw?) then yes. It's illegal in that case since their client isn't free software. If you do own the client, it's only a valid legal client (ethically speaking) when you stick to the ToS. The ToS states: you cannot host your own emulated server.

In case of Helbreath. The client is free, anyone can download it and is able to use it - wether that is for Siementech's servers or not. In case of Helbreath, it's ethically legal to emulate their servers.

But, to be honest. It's what I think. I'll ask my DSO, he is specialized in rights & ethics.
